Original Action Alert:

The Senate has introduced its version of the 2016 New Mexico state budget (SB 158) which includes a provision to take $500,000 from the OHV Trail Safety Fund. The Trail Safety Fund is fully funded by OHV registration and user fees. Apparently, the Senators who included this provision believe that it’s appropriate to take your dedicated OHV funding and use it to help support the State Parks budget where OHV use isn’t allowed. It is also important to note that this transfer isn’t included in the House version of the budget (HB 2).

The OHV Trail Safety Fund is set up under a “user-pay, user-benefit” framework to be used primarily for OHV law enforcement, education and training, information system development and management, resource monitoring and protection, trail building, maintenance and restoration, and the implementation of other provisions of the Off-Highway Motor Vehicle Act (enacted in 2005).

This is tantamount to placing an additional tax on OHV users that provides no benefit to those who pay. It is vital that you act quickly to urge your State Senator to oppose this raid of the Trail Safety Fund!
